The Round Table Pizza name, logo, trademarks, service marks, and trade dress are proprietary to the Company. You may not use any of these marks without our prior written consent. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.

These Terms permit you to use the Site for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as follows:

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials;

5. Payment Terms

When you place an order through our Site, you agree to pay all charges associated with your order, including the price of the food items, applicable taxes, delivery fees, service fees, and any other charges disclosed at the time of purchase.

5.1 Accepted Payment Methods

We accept major credit cards, debit cards, and other payment methods as displayed on the Site at the time of checkout. By providing a payment method, you represent and warrant that you are authorized to use the designated payment method and that you authorize us to charge your selected payment method for the total amount of your order.

5.2 Pricing and Taxes

All prices listed on the Site are in United States Dollars (USD) and are subject to change without notice. We are required by law to collect applicable sales taxes on orders, and the amount of tax charged will be calculated based on the applicable tax rates at the time of purchase in accordance with state and local tax laws.

5.3 Order Confirmation and Cancellations

5.4 Refunds and Disputes

Our refund policy is subject to the specific circumstances of each order. If you are dissatisfied with your order due to an error on our part, please contact us within a reasonable time frame of receiving your order. We will work with you in good faith to resolve any issues. Chargebacks initiated without first contacting us may result in account suspension or termination. Refunds, if approved, will be processed to the original payment method within 5–10 business days, depending on your financial institution.

5.5 Promotional Codes and Discounts

Promotional codes, coupons, and discount offers are subject to their specific terms and conditions, including expiration dates, usage limits, and eligible items. We reserve the right to reject, cancel, or void any promotional code if we determine it has been used fraudulently, in violation of applicable promotional terms, or in violation of these Terms.

ROUND TABLE PIZZA DOES NOT WARRANT THAT:

• THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
• THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE WILL BE ACCURATE OR RELIABLE;
• THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SITE WILL MEET YOUR EXPECTATIONS;
• ANY ERRORS IN THE SITE WILL BE CORRECTED;
• THE SITE OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

While we make reasonable efforts to ensure that allergen and nutritional information displayed on the Site is accurate and up to date, we cannot guarantee the complete accuracy of such information. Customers with food allergies, intolerances, or dietary restrictions should contact us directly before placing an order to discuss their specific needs. Round Table Pizza shall not be liable for any allergic reactions or health issues arising from consumption of our products.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ROUND TABLE PIZZA, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SERVICE PROVIDERS, OR SUCCESSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

• LOSS OF PROFITS, REVENUE, OR BUSINESS;
• LOSS OF DATA OR GOODWILL;
• PERSONAL INJURY OR PROPERTY DAMAGE;
• COST OF SUBSTITUTE GOODS OR SERVICES;
• ANY OTHER INTANGIBLE LOSSES,

ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY CONTENT, PRODUCTS, OR SERVICES MADE AVAILABLE THROUGH THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF ROUND TABLE PIZZA TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE SITE OR ANY PRODUCTS OR SERVICES ORDERED THROUGH THE SITE EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100.00) OR (B) THE TOTAL AMOUNT PAID BY YOU TO ROUND TABLE PIZZA IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by applicable law. Nothing in these Terms shall limit or exclude liability for gross negligence, willful misconduct, fraud, or any other liability that cannot be excluded or limited under applicable law.

8. Indemnification

You agree to defend, indemnify, and hold harmless Round Table Pizza, its parent company, subsidiaries, affiliates, officers, directors, shareholders, employees, contractors, agents, licensors, service providers, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms;
• Your use of the Site or any services offered therein in a manner not authorized by these Terms;
• Your violation of any applicable local, state, federal, or international law or regulation;
• Your infringement of any intellectual property, privacy, or other rights of any third party;
• Any User Content you submit, post, transmit, or otherwise make available through the Site;
• Any misrepresentation made by you;
• Your conduct or actions in connection with your use of the Site or services.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with our defense of such claim. You will not settle any claim that affects us without our prior written consent.

9. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the United States of America and the applicable laws of the state in which Round Table Pizza operates, without giving effect to any choice or conflict of law provision or rule.

You agree that any legal action or proceeding arising under or relating to these Terms or your use of the Site shall be brought exclusively in the federal or state courts of competent jurisdiction in the United States. You hereby consent to personal jurisdiction and venue in such courts and waive any objection as to improper venue or inconvenient forum.

These Terms are also subject to applicable federal laws of the United States, including the Federal Trade Commission Act (FTC Act), 15 U.S.C. § 41 et seq., which prohibits unfair or deceptive acts or practices in commerce, as well as other applicable consumer protection laws. If you are a California resident, additional rights may apply to you under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), as well as the California Business and Professions Code.

Round Table Pizza makes no representation that the Site or its content is appropriate or available for use in locations outside of the United States. Accessing the Site from territories where its contents are illegal is prohibited. Those who choose to access the Site from outside the United States do so on their own initiative and are solely responsible for compliance with applicable local laws.

10. Dispute Resolution

10.1 Informal Resolution

Before initiating any formal legal proceedings, you agree to first contact Round Table Pizza in writing at [email protected] to attempt to resolve the dispute informally. You must provide a written description of the dispute, the relief sought, and your contact information. We will attempt to resolve the dispute within thirty (30) days of receiving your notice. If we are unable to resolve the dispute informally within that period, either party may pursue formal dispute resolution as set forth below.

10.2 Binding Arbitration

To the fullest extent permitted by applicable law, you and Round Table Pizza agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or to the use of the Site or services (collectively, "Disputes"), shall be resolved by binding arbitration, rather than in court, except that either party may bring claims in small claims court if the claims qualify.

The arbitration shall be conducted by a neutral arbitrator in accordance with the rules of the American Arbitration Association (AAA) or JAMS, as applicable. The arbitration shall take place in the United States, in the state where Round Table Pizza is located, unless the parties agree otherwise. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction.

10.3 Class Action Waiver

YOU AND ROUND TABLE PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Round Table Pizza agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any form of a representative or class proceeding.

10.4 Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights, without first engaging in arbitration or the informal dispute-resolution process described above.

11. Term and Termination

These Terms shall remain in full force and effect while you use the Site or any services provided by Round Table Pizza. We reserve the right, in our sole discretion, to:

• Terminate or suspend your access to all or part of the Site for any reason, including without limitation, any violation of these Terms;
• Discontinue the Site or any part thereof at any time without notice;
• Delete your account and all associated data, including order history, saved preferences, and payment information, at our discretion.

Upon termination of your access to the Site or these Terms, your right to use the Site and any services offered therein shall immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may terminate your account at any time by contacting us at [email protected] and requesting account deletion. Termination of your account does not relieve you of any obligations to pay for outstanding orders or any other financial obligations incurred prior to termination.

12. Changes to Terms

Round Table Pizza reserves the right, at its sole discretion, to modify, revise, or update these Terms of Service at any time. When we make changes, we will update the "Last Updated" date at the top of this page. In certain circumstances, we may also provide you with additional notice of such changes, such as by sending an email notification to the address registered in your account or by displaying a prominent notice on the Site.

It is your responsibility to review these Terms periodically and to be aware of any modifications. Your continued use of or access to the Site following the posting of revised Terms constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you are no longer authorized to use the Site and must discontinue use immediately.

No modification of these Terms by you shall be effective unless made in writing and signed by an authorized representative of Round Table Pizza.

13. Severability

If any provision of these Terms of Service is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction or arbitrator, the invalidity, illegality, or unenforceability of such provision shall not affect any other provision of these Terms. The remaining provisions shall continue in full force and effect, and the invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable.

In the event that any provision of these Terms conflicts with applicable law, such provision shall be modified to reflect the parties' original intentions to the fullest extent possible under applicable law, and the remaining provisions of these Terms shall remain in full force and effect.

The failure of Round Table Pizza to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. A waiver of any provision of these Terms shall only be effective if made in writing and signed by an authorized representative of Round Table Pizza.

14. Additional Legal Provisions

14.1 Entire Agreement

These Terms of Service, together with our Privacy Policy and any other legal notices or agreements published by us on the Site, constitute the entire agreement between you and Round Table Pizza concerning your use of the Site and supersede all prior and contemporaneous agreements, understandings, negotiations, and discussions, whether oral or written, between the parties relating to the subject matter herein.

14.2 No Waiver

Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.

14.4 Force Majeure

Round Table Pizza shall not be liable for any failure or delay in performance under these Terms to the extent such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics or epidemics, war, terrorism, civil unrest, government actions, power failures, internet service provider failures, labor disputes, or any other event beyond our reasonable control.

14.5 Notices

All notices required or permitted under these Terms shall be in writing and shall be deemed duly given when delivered by email to the addresses specified herein, or when posted on the Site. Notices to Round Table Pizza must be sent to [email protected]. We may send notices to you at the email address associated with your account or by posting notice on the Site.
